  • mini trial that's happening in DC ahead
  • of the November election Donald Trump
  • seems to have just issued his last gasp
  • to make sure that that doesn't happen
  • can you explain what he just did in
  • court yeah Brian Trump and his lawyers
  • desperately do not want Jack Smith to
  • file what has been called an oversized
  • motion
  • 180 Pages it's due in court on September
  • 26 and it will include all of the
  • evidence of Donald Trump January 6th
  • crimes and they Donald Trump's team just
  • filed something which not surprisingly
  • reads again like a 2 a unhinged social
  • media post from Donald Trump they said
  • judge chuin do not do not let uh special
  • counsel Jack Smith take this quote
  • Lawless action of disclosing all of
  • Donald Trump's crimes in this upcoming
  • oversized motion certainly not before

  • the election they call this proposed 180
  • page filing a
  • monstrosity they say we really want to
  • protect the witnesses and we don't want
  • to taint the jury pool which is another
  • reason they offer as to why Jack Smith
  • should not be permitted to file it feels
  • ironic because Donald Trump is the one
  • who had to be judicially gagged to stop
  • running his mouth about Witnesses
  • putting them in danger and tainting jury
  • pools but now they are all concerned
  • about how Jack Smith simply laying out
  • the facts of Donald Trump's January 6
  • crimes could possibly hurt the witnesses
  • and taint the jury pool so you know this
  • thing is disingenuous from start to
  • finish it really is a politically
  • motivated request that they are making
  • and they're hoping judge chuin will fall
  • for it and we'll say okay we will stop
  • this litigation in its tracks to
  • accommodate your election schedule

  • Donald Trump I have a feeling that's not
  • going to be what judge chuin rules Glen
  • isn't the ultimate irony here that the
  • reason that we're we're doing this whole
  • mini Hearing in DC this mini trial in DC
  • to determine what does or doesn't fall
  • under the umbrella of presidential
  • immunity because Donald Trump's own
  • appointed Supreme Court members decided
  • to to issue that ruling on his behalf
  • and so that's why that's the whole
  • reason that we're here in the first
  • place yes and if irony were still a
  • thing in 2024 this would be quite ironic
  • Donald Trump got what he asked for
  • presidential immunity and what the
  • Supreme Court said is okay Donald for us
  • to decide which acts that you undertook
  • which crimes that you committed in
  • furtherance of your corrupt scheme to
  • retain the power of the presidency after
  • losing a presidential election which
  • ones were official acts of the
  • presidency of the United States such
  • that you can't be prosecuted for them we

  • will grant you immunity and which ones
  • were not the official acts of the
  • president of the United States spoiler
  • alert most of them were not official
  • acts of a president but you want it
  • Donald you got it and the Supreme Court
  • said here's how we're going to go about
  • figuring that out we're going to return
  • the case to judge chuin we're going to
  • direct her to hold this in essence mini
  • trial not precisely a mini trial but
  • hold a hearing where she looks at all of
  • the facts and circumstances that she
  • needs to get from the prosecutors so she
  • can you know look at them decide whether
  • they were official or not official and
  • make her immunity rulings accordingly
  • Donald Trump asked for it and now that
  • he got it he's screaming bloody murder
  • that he doesn't want it so yes Donald
  • Trump wants it always and at the end of
  • the day he's probably not going to get
  • this one Glenn I want to point your
  • attention to one part of this motion

  • uh submitted by the Trump team so Trump
  • cites the unwritten 60-day rule as
  • follows former FBI director James comy
  • says we avoid taking any action in the
  • run-up to an election if we can avoid it
  • so this is Donald Trump invoking James
  • Comey who famously made comments about
  • Hillary Clinton in the leadup to the
  • election which is in part what helped
  • Donald Trump win in 2016 is he just
  • trolling us at this point and that
  • that's the first question the second is
  • will judge shuckin's election calendar
  • Bend to the whims of Donald Trump's
  • electoral calendar considering this
  • prosecution is already well
  • underway yes Donald Trump is trolling us
  • trolling judge chuin and we are living
  • in the legal upside down um two I was in
  • court not once but twice and saw judge
  • Tanya chuin say Point Blank my case this
  • case will not yield to a political
  • election cycle so this are argument

  • we'll get no traction and Brian third
  • the 60-day rule here is what the 60-day
  • rule proposition stands for if for
  • example somebody is running for Congress
  • and the election is 60 days out and that
  • person has not been charged with any
  • crime that person has not had their
  • property searched or their cell phone
  • seized then the Department of Justice
  • should not initiate some law enforcement
  • action
  • like all of a sudden get a search
  • warrant and seize a candidate's phone um
  • in the runup to the election if time is
  • not of the essence why well because it
  • could be misperceived as having a
  • political purpose maybe you know uh
  • damaging the prospects of a candidate
  • being elected however the 60-day rule
  • does not apply once cases are being
  • prosecuted in court why because doj the

  • FBI and the federal prosecutors have
  • complete discretion over the timing of
  • taking a law enforcement action when
  • there is no criminal case up and running
  • there is no prosecution ongoing in court
  • but once charges are brought guess what
  • the Judiciary doesn't have a 60-day rule
  • they will continue to move their case
  • expeditiously through the system as they
  • are required to do and as judge chuin
  • said it does does not depend on or bend
  • to an election cycle so the 60-day rule
  • has absolutely no application and Trump
  • and his lawyers know that and finally
  • Glenn um as we head toward this mini
  • trial barring some cataclysmic event
  • that prevents it from actually happening
  • barring some dilatory tactic by Donald
  • Trump that prevents it from happening at
  • least before the election uh I'm sure
  • that there are people watching this who
  • don't remember why this is even
  • important or who don't know what this is
  • can you give um some insight into why

  • this is important you know Brian the
  • reason this is important is because it's
  • kind of all on the line right now Donald
  • Trump committed lots of crimes he really
  • in substance hasn't denied that he's
  • committed crimes he's just saying he
  • wants immunity he wants the Supreme
  • Court to allow him to get away with
  • those crimes he committed crimes to try
  • to steal a presidential election from
  • the American people he tried to override
  • the expressed will of the American
  • voters and the Supreme Court
  • unfortunately ruled that parts of the
  • Constitution are actually
  • unconstitutional and they bestowed
  • Immunity on a president for certain
  • crimes and now judge chuin has to decide
  • which crimes survive the Supreme Court's
  • horrific ruling and Donald Trump can be
  • prosecuted for in connection with trying
  • to steal the 2020 election and which
  • crimes can he not be prosecuted for and
  • this little hearing that hopefully will

  • be underway very soon after Jack Smith
  • files his 180 page oversized brief
  • disclosing all of the evidence of Donald
  • Trump's j6 crimes hopefully it will move
  • forward we will get some clarity and
  • Donald Trump will be held accountable
  • for at least some of the crimes he
  • committed against the American people in
  • his determination to unlawfully retain
  • the power of the presidency I mean for
  • gosh sakes we're coming up on another
  • presidential election we don't even know
  • about the crimes Donald Trump committed
  • to try to steal the 2020 election and
  • it's high time we get some you know some
  • transparency into that perfectly put and
  • and again the irony of all of this is
  • that this is what Trump wanted his own
  • appointed Supreme Court members gave him
  • the gift of bestowing upon Him
  • presidential immunity and so now this
  • hearing is basically just to decide what
  • is considered an official act and what
  • isn't so Donald Trump wants to have it
  • both ways where he can both benefit from

  • having presidential immunity and yet not
  • have any of his actions under the
  • scrutiny to determine whether they do
  • fall onto that umbrella or not so again
  • hopefully Jack Smith does continue to
  • Barrel ahead um as we move move forward
  • with this mini hearing with this mini
  • trial here in DC with that said Glenn
