Written by Michael Duffy Opinions editor-at-large As the House select committee investigating the events before and during Jan. 6 of last year finished its eighth public hearing Thursday night, attention shifts to the Justice Department and the decisions of Attorney General Merrick Garland. Richard Ben-Veniste, a former Watergate prosecutor and member of the 9/11 Commission, argued in an op-ed that while Garland has investigative powers the select committee lacks, he does not have forever to decide whether to bring charges against a former president. “Employing the prosecutor’s tradecraft takes time,” Ben-Veniste wrote. “Reluctant witnesses have to be confronted with evidence; culpable parties may be granted immunity to induce cooperation against higher-ups. Challenges to grand jury subpoenas must be litigated in the courts.” And with midterm elections looming, a variety of outcomes could complicate a thorough prosecution. “Based on its prior recalcitrance,” Ben-Veniste added, “a Congress under Republican control would be unlikely to support such a probe — and could easily undermine it.” Let us know what you think, and thanks for reading.
