One answer to Alan's key question of what we can do is to ask our Members of Congress to do as they often do and waive the rule against authorizing in an appropriations bill and add to the Treasury and General Government bill, a provision that adds 8 new seats to the Supreme Court and a comparable percentage to the lower courts and uses a portion of their current budget allocation to pay for it pending supplemental appropriations. Approps bills are usually privileged so that they are not subject to filibustering. Van Hollen of MD is the chair of that subcommittee in the Senate. The House has marked up but could add that on the floor and should.

I believe that we need to focus on state legislatures, secretary of State races, and Governor races in all swing states. The reconciliation bill still being negotiated could carry a provision adding funds to increase by 40% or so the number of judges at each level and adding the seats by amending the Judiciary Act in the process given reconciliation bills are exempt from the filibuster and need to affect the size of the budget.

The North Carolina case as the right would have it be decided would run afoul of the 14th Amendment and run afoul of logic in that their interpretation is that state legislatures can ignore their own constitutions in designing the federal elections held in their states. That also runs afoul of the power provided by the Constitution to the House and Senate to determine the legality of the elections that send Members to the next Congress, (in this case, those taking their seats on January 3rd 2023.) CRS has two good reports on this as well vis a vis Section 3 of the 14th and insurrection supporters being barred from state and federal office.

Here is a very helpful analysis done for the Constitution Center of the question of the application of the elections clause and other key elements of the constitution.
This careful analysis, like the plain reading of the constitution, plainly contradicts the simplistic theory which the Supreme Court currently expects to apply it seems, when it rules on the case it is just accepted from North Carolina, in which The right wing interpretation That the language of the elections clause -referring only to the state legislatures -means that the state legislatures can ignore their own constitutions and the other elements of the federal Constitution and the access to the polls of their own voters or lack thereof or the proper counting of the votes or lack thereof when the legislatures decide who wins.

One way to get more people to vote. It's a Tom Hartman idea. Pass Medicare for All and issue Medicare Cards that can be used as voter ID cards. It destroys the Republican talking point of Voter ID and at the same time it will motivate more people to vote. Its a long term solution. In the short term Democrats need to do a better job branding. Inflation is so high because taxes are so low and the Treasury is printing money. The right wing sees this as an opportunity to gut entitlement programs. I suggest that people reach out to find and or create indexes (sic) to monitor the changes. E.G. ActBlue keeps track of Democratic money, both collectively and individually. They can help people develop their own organizing goals. Perhaps they can help people keep track of other types of socially relevant quantities. After all they were founded by scientifically and technically oriented young people to find an effective way to raise money. Flexibility may yet reside with ActBlue. I feel we need to spend less energy on the presidency (except in the rare situation where a Bernie decides to run). The president will always be a disappointment. Our leverage is elsewhere. Focus on Congress, yes – and encourage our progressive stars to climb the ladder to Congressional leadership, rather than aspiring to the presidency. And even more so, focus on state government, where it turns out all the power lies. Downballot Progress is a good new organization focussing on that.
