Hi Peter,
Both companies and investors are facing increasing scrutiny over their sustainability claims. Earlier this month we saw SEC lawyers subpoena several fund managers over ESG disclosures.
Unfortunately, rather than making changes to their products and processes, some businesses have instead looked to making exaggerated or made false claims about their ESG credentials.
Several areas of business and society are now putting these claims under the microscope. As part of a concerted effort by international regulators, the UK Advertising Standards Authority (ASA) has recently taken enforcement action against corporate greenwashing. Airlines, banks, fashion retailers and energy companies are among more than 20 companies targeted by the ASA for making misleading statements and representations about their sustainability credentials.
In a newly published piece Kate Gee and Alex Cheah, both of Signature Litigation, look whether these companies, and their claims, can withstand scrutiny from regulators, activist groups or other key stakeholders.
